COURT OF KING's BENCH. JoHNs0oN V-HADFIELD; HIS was an.a&ion to recover: the value of a caſk of porter ſent by. the plaintiff from Lon-, don to his mother in Yorkſhire, by the veſlel of the defendant, who was a common catrier. 4 2

The evidence provedythat the taſk ofporter was put on board the defend; ant's veſſel, butthat the vital part had eſcaped before it had-got to-its place of deſtination, andthat the liquor was all taken out, and the-caſk was nearly empty when delivered. It was alſo proved; that 11. 1585. was paid for the cärriage. The defence ſet up was, that the defendant did: not inſure at'this räte of payment, but that it was merely for“ the carriage; and that notice was given to all perſons who ſent liquid goods by this hoy, that they muſt Pay a further rate for inſuring a ſafe carriage.

Lord Ellenborough.=-“ The defendant by his ſervants, treated with the perſon who brought the porter, and bound.by their a&s. One pound fifteen Ihillings was a large ſum to pay for a caſk of poyvter, and I do not know, that inſurance wasnot included in that ſum. They did not tell the perſon that brought them this porter, that there muſt be.an inſurance; andif I were to hold that this inſurance was neceſſary, unleſs they had given her-a&ual notice of it, there would be no ſecurityin trade» People who went to. theſe places with their goods muſtbe Jawyers. It was enough that ſhe paid all they de- manded.
