2. Shipment to be commenced and completed
3. Seller to hove the option of delivering 5% more or less, but any surplus or deficiency on the mean quantity to be settled for at the market price on the day of arrival.
4. Payments to be made by cash less 2 ½% discount in 14 days from date of delivery in Hull, or against delivery order if required, interest being allowed on all prepayments at the rate of 5% per annum.
5. In the case of war, prohibition of Export, or blockade, or the close of the navigation by ice, or closing of the Sound preventing shipment, this contract—or any unfulfilled part thereof—to be cancelled, as also in the event of steamer being lost at sea.
6. Should the Seller be prevented from delivering the goods sold, or the Buyer from taking delivery as provided by the Rules, by reason of Riots, Strikes, or Lock-outs at the place named for delivery, the time for delivery shall be extended until the operation of the causes preventing delivery has ceased. In the event of the steamer being able to discharge the goods into craft or warehouse, this to be deemed a delivery as if from steamer and accepted by the Buyer accordingly; Buyer paying current port rates, any excess thereon to be equally divided between Buyer and Seller.
7. Samples of the above Linsced to be taken by Corporation sworn weighers during discharge, and the same to be analysed by the Incorporated Oilseed Association, London. Seller paying for less than pure Linsced, and Buyer for more than pure Linsced, oleaginous substances other than Linseed not to be charged for.
8. In the event of the shipment under this Contract forming part of a bulk, receivers shall as far as practicable, take pro ratà quantities. Any damage or sweepings to be received in proportion by the receivers of the said bulk.
9. Any shipment in partial execution of this contract to be deemed and accepted as made under a separate contract.
10. Any dispute or disputes arising out of this contract, shall be referred to Arbitration in Hull according to the printed rules endorsed on this contract, and this stipulation to be made a rule of the Supreme Court of Judicature on the application of either contracting party. Any claim must be made in writing within 14 days after arrival of the goods in Hull.
